{"id":14824,"date":"2024-05-10T09:22:34","date_gmt":"2024-05-10T07:22:34","guid":{"rendered":"https:\/\/observatorio.umh.es\/?page_id=14824"},"modified":"2026-07-01T12:57:05","modified_gmt":"2026-07-01T10:57:05","slug":"derechos-deberes-y-normativa-aplicable-en-el-programa-de-practicas","status":"publish","type":"page","link":"https:\/\/observatorio.umh.es\/en\/derechos-deberes-y-normativa-aplicable-en-el-programa-de-practicas\/","title":{"rendered":"Rights, duties, and applicable regulations in the internship program"},"content":{"rendered":"<p><\/p>\n<p style=\"text-align: justify\"><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Participation in the Miguel Hern\u00e1ndez University internship program implies acceptance of the following conditions by the collaborating entity, the student, and the UMH itself.<\/span><\/span><\/p>\n<p style=\"text-align: justify\"><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Ref. DYD-02\/15<\/span><\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><em><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">The parties agree to:<\/span><\/span><\/em><\/p>\n<ul style=\"text-align: justify\">\n<li><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Respect the confidentiality of all information and data that, by any means, comes to your knowledge<\/span><\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\"> \u00a0as a result of your internship at the Entity, and do not disclose or reproduce it in any way outside the internship site or during interviews with your UMH academic supervisor. In this regard, Article 10 of Organic Law 15\/1999, of December 13, on the Protection of Personal Data (LOPD), mandates the duty to safeguard this information, an obligation that remains in effect after the internship ends. This data may refer to clients, patients, users, and, in general, all third parties who directly or indirectly contact the internship Entity; it also includes any facts observed by the student or reported by the internship staff that refer to said staff. Specifically, this includes personal data contained in automated or non-automated files of the internship entity, under the terms established in the LOPD.<\/span><\/span><\/li>\n<li><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Do not use, reproduce, disseminate or commercially exploit other actions of an analogous nature, beyond the Memory or Work itself of the activities developed in the practices<\/span><\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\"> , with respect to the work carried out or in the process of being carried out in the practice center, and which benefit from the protection conferred on them by the Intellectual Property Law, approved by Royal Legislative Decree 1\/1996, of April 12, Law 20\/2003, of July 7, on Industrial Design, Law 17\/2001, of December 7, on Trademarks, Law 11\/1986, of March 20, on Patents, all of them with the corresponding modifications.<\/span><\/span><\/li>\n<li><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Submit, where applicable, an interim progress report and, mandatorily, a final report to be submitted to the academic tutor<\/span><\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\"> , as well as any additional information that the academic tutor may require to issue their evaluation.<\/span><\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">The student will not carry out more than 1,800 hours <\/span><\/span><\/strong>\u00a0<strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">of extracurricular internships in the same entity during his entire academic life at UMH.<\/span><\/span><\/strong><\/p>\n<ul style=\"text-align: justify\">\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">The personal data included in the internship annex will be incorporated into a file owned by the UMH for the management of student internships. This data will be used exclusively for employment management, company internships, and job training, as well as for conducting surveys, studies, and promoting activities of the Occupational Observatory. The necessary personal data will be transferred to the company that formalizes the students&#8217; insurance policy, the Labor Inspection body, and the collaborating entity where the internship will take place. This entity undertakes not to use the data for any other purpose, not to disclose it to third parties without the consent of the data subjects, and to comply with security measures and other obligations arising from personal data protection legislation. Therefore, refusal to allow this transfer would prevent the signing of this document. In any case, the rights of access, rectification, cancellation and opposition can be exercised by means of a written communication, attaching a photocopy of the ID card or other identification document, addressed to the Occupational Observatory of the UMH, La Galia Building, Avenida de la Universidad s\/n, 03202 Elche.<\/span><\/span><\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Students will be covered by a health insurance policy taken out by the UMH for this purpose. In the event of an accident, they must notify the insurance company by calling the 24-hour incident hotline at 918 365 365, quoting policy number 055-1880010495, and will be assigned a case number. They must also immediately report this incident to the Occupational Observatory at <\/span><\/span><a class=\"mail-link\" data-enc-email=\"bofreingbevb[at]hzu.rf\" data-wpel-link=\"ignore\"><span id=\"eeb-701316-296087\"><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">observatorio@umh.es<\/span><\/span><\/span><\/a><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\"> or by phone at 96.665.8646.<\/span><\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">In the case of internal internships:<\/span><\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">The student acknowledges that the internship agreement has no academic validity until it has been reviewed by the corresponding Credit Transfer Committee, after the internship has been completed and the reports from the professional and academic supervisors have been evaluated. The student accepts the terms and conditions set forth in the Rector&#8217;s Resolution on Internal Internships and its annex. Furthermore, the student agrees to maintain professional confidentiality regarding any information acquired related to the production process, technical systems used by the company, any economic, commercial, organizational, or other similar aspects, and assumes any liability that may arise from a breach of these rules. The student must also submit an interim report and a final report detailing the tasks performed during the internship.<\/span><\/span><\/p>\n<h1 style=\"text-align: justify\"><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">APPLICABLE REGULATIONS<\/span><\/span><\/strong><\/h1>\n<p style=\"text-align: justify\"><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">1. INTRODUCTION.<\/span><\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">On December 10, 2011, Royal Decree 1707\/2011 was published, regulating internships for university students. This decree was annulled by a Supreme Court ruling, which reinstated Royal Decrees 1497\/1981, of June 19, on Educational Cooperation Programs, and its subsequent amendment by Royal Decree 1845\/1994, of September 9. Subsequently, on July 30, 2014, new regulations governing external internships for university students were published: Royal Decree 592\/2014, of July 11, which remains in force today.<\/span><\/span><\/p>\n<p style=\"text-align: justify\"><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">2. RIGHTS AND OBLIGATIONS OF TUTORS AND STUDENTS IN INTERNSHIPS AT THE MIGUEL HERN\u00c1NDEZ UNIVERSITY OF ELCHE.<\/span><\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">According to\u00a0 <\/span><\/span><a href=\"http:\/\/www.boe.es\/boe\/dias\/2014\/07\/30\/pdfs\/BOE-A-2014-8138.pdf\"><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Royal Decree 592\/2014<\/span><\/span><\/a><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\"> , of July 11, when carrying out internships in companies, there are a series of rights and obligations to which all the parties involved are subject: the student who is going to start the internship, their academic tutor, who is in charge of facilitating the internships to the student from the educational center, and their professional tutor, who is the person in charge of the professional training of the student in the collaborating entity.<\/span><\/span><\/p>\n<p style=\"text-align: justify\"><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">2.1. Rights and duties of students in internships.<\/span><\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">As indicated above, students during the internship period have a series of rights and duties that they must fulfill with the collaborating entity and with their teaching center, which are the following:<\/span><\/span><\/p>\n<p style=\"text-align: justify\"><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Rights<\/span><\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\"> :<\/span><\/span><\/p>\n<ol style=\"text-align: justify\">\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Under their supervision, during the practice period, both from the teacher of their center and from a professional of the collaborating company, institution or entity.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">The evaluation will be based on the criteria established by the University (law) and the report of the academic tutor.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">To obtain a report from the collaborating entity, with express mention of the activity carried out, its duration and, where applicable, its performance (see <\/span><\/span><a href=\"https:\/\/observatorio.umh.es\/files\/2025\/04\/MODELO-DE-CERTIFICADO-DE-PRACTICAS-profesional.docx\"><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">model of internship certificate<\/span><\/span><\/a><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\"> ).<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">To receive, if so stipulated, the financial contribution of the collaborating entity, as a study aid fund.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">To intellectual and industrial property in the terms established in the legislation regulating the matter.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">To receive information from the collaborating entity regarding safety regulations and prevention of occupational risks.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">To fulfill their academic activity, after giving sufficient advance notice to the collaborating entity.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">To provide the necessary resources for students with disabilities to access guardianship, information, evaluation and the performance of internships under equal conditions.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">To reconcile, in the case of students with disabilities, the completion of internships with those activities and personal situations arising from the disability.<\/span><\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify\"><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Homework:<\/span><\/span><\/strong><\/p>\n<ol style=\"text-align: justify\">\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Provide all the necessary documentation and personal information to begin the internship.<\/span><\/span><\/li>\n<li>Conocer y cumplir la normativa vigente relativa a pr\u00e1cticas externas establecidas por la universidad y el Proyecto Formativo de las pr\u00e1cticas.<\/li>\n<li>Mantener contacto con el tutor acad\u00e9mico de su centro durante el desarrollo de la pr\u00e1ctica y comunicarle cualquier incidencia que pueda surgir en el mismo.<\/li>\n<li>Hacer entrega de los documentos e informes de seguimiento intermedio as\u00ed como la memoria final que le sean requeridos.<\/li>\n<li>Incorporarse a la entidad colaboradora de que se trate en la fecha acordada, cumplir el horario previsto y respetar las normas de funcionamiento, seguridad y prevenci\u00f3n de riesgos laborales de la misma.<\/li>\n<li>Guardar confidencialidad en relaci\u00f3n con la informaci\u00f3n interna de la entidad y guardar secreto profesional durante su estancia y una vez finalizada.<br \/>\nMostrar una actitud respetuosa hacia la pol\u00edtica de la entidad colaboradora.<\/li>\n<\/ol>\n<p style=\"text-align: justify\"><strong>2.2. Derechos y deberes del\u00a0tutor acad\u00e9mico.<\/strong><\/p>\n<p style=\"text-align: justify\">El tutor acad\u00e9mico es el encargado de facilitar, en medida de lo posible, que el alumno realice las pr\u00e1cticas convenientes para poder finalizar sus estudios con \u00e9xito. \u00c9ste tambi\u00e9n tiene una serie de derechos y deberes que cumplir:<\/p>\n<p style=\"text-align: justify\"><strong>Derechos:<\/strong><\/p>\n<ol style=\"text-align: justify\">\n<li>Al reconocimiento efectivo de su actividad acad\u00e9mica en los t\u00e9rminos que establezca la Universidad, de acuerdo a su normativa interna.<\/li>\n<li>Ser informado acerca de la normativa que regula las pr\u00e1cticas externas as\u00ed como del Proyecto Formativo y de las condiciones bajo las que se desarrollar\u00e1 la estancia del estudiante a tutelar.<\/li>\n<li>Tener acceso a la entidad colaboradora para el cumplimiento de los fines propios de su funci\u00f3n.<\/li>\n<\/ol>\n<p style=\"text-align: justify\"><strong>Deberes:<\/strong><\/p>\n<ol style=\"text-align: justify\">\n<li>Velar por el normal desarrollo del Proyecto Formativo, garantizando la compatibilidad del horario de realizaci\u00f3n de las pr\u00e1cticas con las obligaciones acad\u00e9micas, formativas y de representaci\u00f3n y participaci\u00f3n del estudiante.<\/li>\n<li>Hacer un seguimiento efectivo coordin\u00e1ndose para ello con el tutor profesional del alumno.<\/li>\n<li>Autorizar e informar de las modificaciones que se produzcan en el Proyecto Formativo.<\/li>\n<li>Llevar a cabo el proceso evaluador de las pr\u00e1cticas del estudiante tutelado.<\/li>\n<li>Guardar confidencialidad en relaci\u00f3n con cualquier informaci\u00f3n, tanto del alumno\u00a0 tutelado como de la empresa colaboradora, como consecuencia de su actividad como tutor.<\/li>\n<li>Informar al \u00f3rgano responsable de las pr\u00e1cticas externas en el centro docente de las posibles incidencias surgidas.<\/li>\n<li>Supervisar, y su caso solicitar, la adecuada disposici\u00f3n de los recursos de apoyo necesario para asegurar que los estudiantes con discapacidad realicen pr\u00e1cticas en condiciones de igualdad de oportunidades, no discriminaci\u00f3n y accesibilidad universal.<\/li>\n<li>Asistir puntualmente a las sesiones de tutor\u00eda acad\u00e9mica previamente acordadas con su tutelado.<\/li>\n<\/ol>\n<p style=\"text-align: justify\"><strong>\u00a02.3. Derechos y deberes del tutor profesional.<\/strong><\/p>\n<p style=\"text-align: justify\">El tutor profesional es el encargado de la formaci\u00f3n profesional del alumno en pr\u00e1cticas desde la entidad colaboradora, tiene que cumplir una serie de derechos y deberes.<\/p>\n<p style=\"text-align: justify\"><strong>Derechos:<\/strong><\/p>\n<ol style=\"text-align: justify\">\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">You will be entitled to recognition of your collaborative activity by the university. The professional supervisor may request a certificate of supervision for the internships they have overseen.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">To be informed about the regulations governing external internships, as well as the Training Project and the conditions for its development.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Having access to the university to obtain the information and support necessary for the fulfillment of the purposes of their function.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">The professional tutor can request the \u201cUMH Tutor Card\u201d which will allow him to use library services, access parking, enjoy sports facilities and benefit from the services and commercial discounts enjoyed by members of the university community on all campuses.<\/span><\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify\"><strong><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Homework:<\/span><\/span><\/strong><\/p>\n<ol style=\"text-align: justify\">\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Welcome the student and organize the activity to be developed in accordance with the provisions of the Training Project.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Supervise the student&#8217;s activities, guide them and monitor the development of the practice with a relationship based on mutual respect and commitment to learning.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Inform the student about the organization and operation of the entity and the regulations of interest, with special attention to those related to safety and occupational risks.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Coordinate with the student&#8217;s academic tutor regarding the development of the activities established in the educational cooperation agreement, as well as for the resolution of any incidents that may arise during the internship and the control of permissions for the student to take exams.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Issue the interim and final reports.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Provide the student with the supplementary training they need to complete the internship.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">To provide the student with the necessary material resources for the development of the practice.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">To facilitate and encourage the contribution of proposals for innovation, improvement and entrepreneurship by the student.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">To facilitate the student&#8217;s academic tutor&#8217;s access to the entity for the fulfillment of the purposes of their function.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Maintain confidentiality regarding any information you learn about the student as a result of your activity as a tutor.<\/span><\/span><\/li>\n<li><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">To provide help and assistance to the student, during their stay at the entity, in order to resolve any professional issues that they may need in the performance of the activities they carry out therein.<\/span><\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify\"><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Internal internships (those carried out by UMH students at UMH itself) are regulated by the Governing Council Agreement of 08\/11\/06 which approved the\u00a0 <\/span><\/span><a href=\"https:\/\/universite.umh.es\/_web_rw\/boumh\/docs\/1719_VDO%20AAEE%20PRACTICAS%20INTERNAS.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Regulations for the Internal Internship Plan of UMH Students<\/span><\/span><\/a><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\"> .<\/span><\/span><\/p>\n<p style=\"text-align: justify\"><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">On the other hand, there are specificities in carrying out internships in companies when these are paid, which includes\u00a0 <\/span><\/span><a href=\"https:\/\/observatorio.umh.es\/cotizacion-de-practica-al-regimen-general-de-la-seguridad-social\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\">Social Security obligations<\/span><\/span><\/a><span dir=\"auto\" style=\"vertical-align: inherit\"><span dir=\"auto\" style=\"vertical-align: inherit\"> .<\/span><\/span><\/p>\n<p><\/p>\n<div class='bookmarkify'><a name='bookmarkify'><\/a><div class='linkbuttons'><a
